• Project Details: Information you provide related to Flooring services
• Communication Data: Content of messages, call logs, and your communication preferences
• Usage Data: IP address, browser type, device information, and interactions with our website
• SMS Consent Records: For each SMS opt-in, we retain a record of the date and time, IP address, form URL, the disclosure language presented, and the consent version

This section describes how Bellus Installation Group LLC (operating as "Bellus Flooring") collects, uses, retains, and protects your mobile phone number and related information when you opt in to receive SMS or text-message communications from us.

Program Identification

Program Name: Bellus Flooring Customer Notifications. Program Operator: Bellus Installation Group LLC. Use Case: Customer care, appointment confirmations, project updates, and related transactional communications. The program is operated only in the United States.

Consent and Eligibility

• Express Written Consent: By checking the SMS consent box on our website forms, you provide your prior express written consent (under the Telephone Consumer Protection Act ("TCPA"), the federal E-SIGN Act, and applicable state laws) to receive SMS communications from us at the mobile number you provide, including communications delivered using automated dialing technology.
• Not a Condition of Purchase: Consent to receive SMS messages is not required to purchase any goods or services from us, and refusing or revoking consent will not affect the products, services, or pricing available to you.
• Eligibility: You confirm that (a) you are at least 18 years old or the age of majority in your jurisdiction; (b) the mobile number you provide is your own, or you have authorization from the account holder to enroll it; and (c) the information you provide is accurate.
• Unbundled Consent: SMS consent is requested through a separate, optional, non-pre-checked checkbox that is distinct from any other agreement, including agreement to our Terms of Service or Privacy Policy.
• Record of Consent: We retain a record of each opt-in event (date/time, IP address, form URL, disclosure language presented, and consent version) for at least four (4) years to satisfy TCPA and state-law statute-of-limitations requirements.

No Sharing or Sale of Mobile Information for Marketing

• No Sharing for Marketing: Mobile information and SMS opt-in data — including your phone number, consent records, and any data collected as part of the SMS program — will not be shared, sold, rented, leased, or otherwise transferred to third parties, affiliates, partners, lead generators, data brokers, or analytics providers for marketing or promotional purposes, at any time.
• State Law Coverage: This restriction applies regardless of how the terms "sale," "share," "cross-context behavioral advertising," or "targeted advertising" are defined under any applicable U.S. state privacy law, including but not limited to the CCPA/CPRA (California), VCDPA (Virginia), CPA (Colorado), CTDPA (Connecticut), UCPA (Utah), TDPSA (Texas), OCPA (Oregon), MCDPA (Montana), ICDPA (Iowa), DPDPA (Delaware), NHPA (New Hampshire), NJDPA (New Jersey), MCDPA (Minnesota), TIPA (Tennessee), INCDPA (Indiana), Florida Digital Bill of Rights, MODPA (Maryland), KCDPA (Kentucky), Rhode Island Data Transparency and Privacy Protection Act, and any successor or analogous laws.
• No Onward Disclosure: Service providers we use to deliver SMS messages are contractually prohibited from using mobile information for their own marketing or from disclosing it to additional third parties for marketing.

Message Content

• Messages may include: appointment confirmations and reminders, scheduling changes, on-the-way and arrival notifications, project status updates, photos or attachments related to your project, follow-up to inquiries you initiate, customer-care responses, satisfaction surveys, warranty and service notifications, and similar transactional or relationship-based communications.
• Messages will not be used for promotional purposes unrelated to the services you have inquired about, unless you provide separate, additional consent for marketing messages.

Message Frequency

Message frequency varies based on your engagement, the status of your inquiry or project, and operational events. Frequency is generally higher during active project phases (e.g., scheduling, in-progress, completion) and lower at other times.

Opt-Out and Revocation of Consent

• Any Reasonable Means: Consistent with FCC rules, you may revoke your consent to receive SMS messages at any time and by any reasonable means.
• By Reply: Reply STOP, END, CANCEL, UNSUBSCRIBE, QUIT, or REVOKE to any SMS message from us.

• By Mail: Send a written request to 2111 Sam Bass Rd #1400, Round Rock, TX 78681.

• Re-Subscription: Reply START or SUBSCRIBE to re-enroll, or complete the consent process again on our website.
• No Affiliate Transfer: Your consent is specific to Bellus Installation Group LLC and does not extend to any affiliate, parent, subsidiary, successor, or unrelated third party. Revocation likewise applies only to this program.

Message and Data Rates

Standard message and data rates may apply to each message you send or receive, depending on your wireless carrier and service plan. Bellus Flooring does not charge a fee to receive SMS messages from this program. We are not responsible for charges imposed by your carrier.

Carrier Information

• Supported Carriers: This program is supported on major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, and most regional carriers and MVNOs.
• Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages.
• Filtering: Carriers and their filtering vendors may filter, block, or rate-limit messages at their discretion. We are not responsible for messages that are blocked or filtered by your carrier.

Sending Hours

Non-emergency messages are sent within hours permitted by the TCPA and applicable state law, generally 8:00 AM to 9:00 PM in the recipient's local time zone. Time-sensitive service messages you have specifically requested (for example, an immediate appointment-arrival notice) may be sent outside these hours where lawful and necessary.

Automated, AI-Assisted, and Algorithmic Communications

• Automated Dialing Technology: Some messages are sent using automated dialing technology and pre-set or templated content. By opting in, you consent to receive such messages.
• AI-Assisted Drafting: Some messages may be drafted, summarized, personalized, or translated with the assistance of artificial intelligence or machine-learning tools. Material outbound communications are reviewed by a human or sent through pre-approved templates.
• No Synthetic Voice in This Program: AI-generated synthetic voice technology is not used in this SMS program. Any voice calls are governed by separate consent and applicable FCC rules concerning AI-generated voice.
• No Solely Automated Decisions With Legal Effects: The SMS program is not used to make decisions that produce legal or similarly significant effects concerning you (such as credit, employment, housing, or insurance decisions) without human involvement.
• State AI Disclosures: Where required by state law (for example, California's bot-disclosure law), automated communications will include a clear disclosure that they are sent by an automated system.

Rich Messaging (MMS / RCS)

Messages may include multimedia content (MMS) such as images, video, or attachments related to your project, and may be delivered over Rich Communication Services (RCS) where supported by your device and carrier. Rich messages are subject to the same consent, opt-out, and privacy terms as standard SMS.

Two-Way Messaging

• This program supports two-way conversation. Replies you send to us — including text, images, attachments, and metadata — are received, stored, and processed by us and our service providers solely to deliver the program described in this section, and are subject to the rest of this Privacy Policy.
• Please do not include sensitive information such as Social Security numbers, payment-card numbers, banking credentials, government identifiers, or detailed health information in SMS messages.

Service Providers and Subprocessors

• We use vetted service providers to deliver SMS messages and operate this program, including: Twilio Inc. (messaging delivery and infrastructure), The Campaign Registry (TCR) (campaign registration and vetting), and additional providers for hosting, customer-relationship management, and analytics.
• Each service provider is bound by a written agreement that limits their use of your information to providing services on our behalf, prohibits the sale of your information, prohibits use of your information for the provider's own marketing, and requires appropriate technical and organizational security measures.
• An up-to-date list of subprocessors is available on request at Jgallagher@bellusflooring.com.

Phone Number Ownership and Reassignment

• You represent that the mobile number you provide is your own, or that you have authority to enroll it.
• If you change, port, or relinquish your mobile number, please notify us at Jgallagher@bellusflooring.com or +15128669325 so we can update our records and avoid sending messages to a subsequent subscriber of that number.
• We use commercially reasonable measures, including reassigned-number databases where available, to identify numbers that have been reassigned to a new subscriber and to suppress messaging to those numbers.

Sensitive Information

• Please do not transmit sensitive personal information — including Social Security numbers, full payment-card or bank-account numbers, government identifiers, precise geolocation, biometric or genetic data, detailed health information, immigration status, or login credentials — through SMS. SMS is not a secure channel for such information.
• If you choose to send such information by SMS, you do so at your own risk, and we will use reasonable efforts to redact, segregate, or delete it.

Engagement and Delivery Tracking

We and our service providers may collect operational metadata about your messages, such as delivery status, error codes, send time, message length, carrier, opt-out events, and whether links contained in messages are clicked. This information is used to operate and improve the SMS program, ensure deliverability, comply with carrier and regulatory requirements, and prevent abuse. It is not sold or shared for cross-context behavioral advertising.

Geographic Scope

This program is intended for recipients located in the United States. International message and data rates may apply if you are roaming. We do not knowingly send messages to recipients outside the United States.

Minors

This program is not directed to children under the age of 18. We do not knowingly collect mobile numbers from, or send SMS messages to, individuals under 18. If we become aware that we have collected information from a person under 18, we will delete it promptly.

Lawful Bases and Carve-Outs

Even after you opt out of marketing or non-essential SMS, we may retain or process limited information where necessary to: (a) comply with legal, regulatory, or court-ordered obligations (including TCPA recordkeeping and litigation holds); (b) prevent, detect, or investigate fraud or abuse; (c) protect the vital interests of you or another person (for example, in a safety emergency); (d) defend legal claims; or (e) maintain suppression lists so that we do not contact you again.

Material Changes

If we make a material change to this SMS program (for example, a new use case, a new sender, or a meaningful change in frequency or content), we will notify active subscribers in advance by SMS or email and update the effective date of this Privacy Policy before the change takes effect. Continued participation after the effective date constitutes acceptance of the change.

We are committed to protecting your privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information collected exclude text messaging originator opt-in data and consent — this information will not be shared with any third parties for any purpose other than delivering the messages you have requested. We do not sell, rent, or lease our customer lists to third parties.

This restriction applies regardless of how "sale," "share," "cross-context behavioral advertising," or "targeted advertising" are defined under any applicable U.S. state privacy law.

We implement reasonable and appropriate administrative, technical, and physical safeguards to protect your personal information from unauthorized access, loss, misuse, or disclosure — including encryption in transit (TLS) and at rest, role-based access controls, audit logging, vendor security reviews, and incident-response procedures. No system is perfectly secure; in the event of a security incident materially affecting your information, we will notify you and applicable regulators as required by law and without undue delay.

• We retain your information only as long as necessary to fulfill the purposes outlined in this policy or as required by law.
• SMS Records: Mobile numbers and SMS records are retained for as long as you are subscribed and for a reasonable period thereafter to comply with our legal, tax, audit, regulatory, and dispute-resolution obligations — generally not less than four (4) years following your last message, unless a longer period is required by law.
• Suppression Records: Numbers that have opted out are retained indefinitely to ensure we do not message a number that has revoked consent.
• Deletion Requests: You may request deletion of your information at Jgallagher@bellusflooring.com, subject to our right to retain consent records, suppression records, and information required by law.

Depending on your state of residence, you have the right to:

• Access, update, correct, or request deletion of your personal data
• Obtain a portable copy of your information
• Opt out of certain processing such as targeted advertising, "sale," "sharing," or profiling
• Withdraw consent to SMS or marketing communications at any time
• Request more details on how your data is used

Universal Opt-Out: We honor recognized universal opt-out mechanisms such as Global Privacy Control (GPC) on our website where required by applicable law.

Authorized Agents: You may use an authorized agent to submit privacy-rights requests on your behalf, subject to verification of the agent's authority.

Verification: To protect your information, we will verify your identity before fulfilling certain requests by asking for information that matches our records.

Response Time: We will acknowledge requests within ten (10) business days and respond substantively within forty-five (45) days, with one extension of up to forty-five (45) additional days where reasonably necessary.

Appeals: If we decline a request, you may appeal by contacting Jgallagher@bellusflooring.com with the subject "Privacy Rights Appeal." If your appeal is denied, you may contact your state attorney general or other applicable supervisory authority.

No Discrimination & No Fee: We will not deny services, charge different prices, or provide a different level of service because you exercise privacy rights. Privacy-rights requests are free, except in the rare case of manifestly unfounded or excessive requests.

To exercise any of these rights, please contact us using the information below.

Our website may include links to external websites. We are not responsible for the privacy practices or content of those third-party sites.

This Privacy Policy may be updated from time to time. Changes will be reflected by updating the "Last Updated" date at the top of this page. Material changes affecting active SMS subscribers will be communicated by SMS or email before taking effect. We encourage you to review this policy periodically.
